PRIME MOTION – TERMS AND CONDITIONS
1. GENERAL
1.1 Prime Motion is an online fitness platform that provides users with live exercise workouts, pre-recorded workouts, an online video library of exercise classes and branded merchandise. These live exercise workouts are streamed via the internet.
1.2 The terms apply to any service you may receive from Prime Motion, whether you register an account or are an unregistered user/visitor to the website. You agree that by accessing Prime Motion’s services, you are entering into a legally binding agreement between you and Prime Motion regarding the use of our services. In doing this, you also agree that you have read and understood Prime Motion’s Privacy Policy. Included in the Privacy Policy is Prime Motion’s medical disclaimer where, by you continuing to access our services, means you acknowledge the sessions can sometimes be physically demanding and it is your responsibility to consult with a medical professional beforehand if you deem it appropriate. In addition, you waive any and all claims which may arise out of your participation in any of Prime Motion’s classes.
1.3 If you do not agree to be bound by this agreement, you are prohibited from accessing or using this website and Prime Motion reserves the right to remove your account. All content on the website is for information purposes only and is prohibited from being distributed other than by Prime Motion.
1.4 Prime Motion may, from time to time, amend this agreement. Any substantial amendments will be communicated to you with at least seven days’ notice before any changes take effect. You take responsibility to check the Terms and Conditions from time to time for any changes.
2. ONLINE CLASSES AND VIDEO SUBSCRIPTION
2.1 Prime Motion’s classes are delivered live through Zoom.com. As this is a tool used via the internet, you accept that software and hardware is never wholly free from technical issues which is not at the fault of Prime Motion. Quality of the streamed classes may be affected by available bandwidth in your area and may also vary from device to device, therefore Prime Motion offers no warranties for the quality of the stream.
2.2 Bookings are made via Prime Motion’s website, primemotion.co.uk by purchasing the relevant pass (weekly pass or four week pass).
2.3 After purchasing the relevant pass, customers must select the classes they wish to attend using the Online Class Calendar. This will alert the website to send the customer a confirmation email with the class login details for that particular class.
2.4 Customers must book onto a class via the website no later than 10 minutes before the class is due to start. Failure to pre-book may result in Charlie Babb not allowing you into the online class or removing you from the online class. This includes failure to communicate your identity if asked at the beginning of the class.
2.5 Customers must join a class, meaning they must be in the Zoom ‘waiting room’, 5 minutes prior to the time shown on the timetable, to enable Charlie Babb of Prime Motion time to let participants into the class. Lateness may result in the customer forfeiting the session, which will not be refunded.
2.6 Prime Motion may record classes, but individual’s personal details will not be present on the recording. The participants are muted, and the image recorded is only ever of Charlie Babb of Prime Motion.
2.7 Prime Motion may, with reasonable notice, change the class timetable at any time. This includes the addition or removal of any classes as part of the subscription.
2.8 There will be time throughout the year where Charlie Babb of Prime Motion is not teaching classes due to annual leave. The video subscription service, accessed via the website’s video library, will act as a substitute service in this instance.
2.9A weekly pass will grant the customer a minimum of 6 classes per week.
2.10 In the instance where Charlie Babb of Prime Motion needs to cancel a class due to unforeseen circumstances, customers will be provided with a pre-recorded video of the same class they were due to attend. For those customers who have purchased a weekly or four weekly pass, if the number of classes that week falls below 6 in total (see clause 2.9), customers will be provided with a credit of the missed classes to attend at a later date. If this is not suitable, a refund of the missed classes will be given. For single passes, credit will be provided in the first instance. If this is not suitable, a refund will be given.
2.11 Members must be 18 years or older to attend the online classes.
3. PAYMENT, FEES AND ATTENDANCE
3.1 By completing the registration process and purchasing any service or goods from Prime Motion’s website, you are creating an agreement between you and Prime Motion and accept all the Terms and Conditions in this agreement. This agreement thus becomes legally binding.
3.2 Every customer using a service given by Charlie Babb of Prime Motion must create an individual account via the website and pay individually.
3.3 Payments of class passes or pre-recorded videos are made prior to any class you attend or stream.
3.4 Passes purchased are non-refundable and are not able to be rolled over to time periods not covered by the pass which has been purchased.
3.5 Class passes are non-transferable from one person to another.
3.6 Non-attendance of a class will result in the customer forfeiting the payment for that class. Non-attendance of a class in no circumstance gives you credit for that class.
3.7 Only you as the named person in the online member joining process can benefit from Prime Motion’s agreement. Therefore, payment of passes and the online video subscription is for one customer only, not per household. If there is more than one customer using a service, Prime Motion reserves the right to remove the customer from the class and receive payment for any additional customers benefitting from the service provided or cancel the customers video subscription licence with immediate effect. Prime Motion reserves the right to refuse membership permanently for those customers who violate this clause.
3.8 If you are given a promotional code, this is for single use only. Prime Motion reserves the right to terminate any account who violates this clause.
4. COMMUNICATIONS
4.1 You agree to receive communications from Prime Motion via electronic means. We will communicate via email, Whatsapp, Zoom (during live classes) and other electronic means or by posting updates and notices on the Prime Motion website. To unsubscribe from such correspondence please contact charliebabbpt@outlook.co.uk.
5. MISCELLANEOUS
5.1 You agree to access content via the Prime Motion website for your own personal benefit. You are prohibited from modifying, downloading, exploiting or reselling any of the contents of the website. This includes the distribution of any login details for any of the services provided by Charlie Babb of Prime Motion.
5.2 All materials and contents, except for images provided by third parties, on the website are copyrighted materials belonging exclusively to Charlie Babb of Prime Motion.
5.3 All data, photographs, videos, messages or other data materials, posted privately or publicly are the sole responsibility of the person who the content of this data originated which means you are responsible entirely for the content you post on email or via Prime Motion’s social media outlets.
5.4 You agree to use Prime Motion’s website and online classes for lawful purposes. You are prohibited from acting in any unlawful, threatening, defamatory, hateful, harmful or otherwise objectionable way that would be considered a criminal offence or cause offence to others. Prime Motion reserves the right to remove any such content, remove users from classes or prohibit the users from attending classes in the future.
6. GOVERNING LAW
6.1 All terms are governed by English law which has exclusive jurisdiction.
