PRIME MOTION – PRIVACY POLICY

1. SCOPE

    1. 1.1 Prime Motion is a business supplying online classes, recorded online fitness material and branded merchandise. The online fitness material is delivered directly to an individual’s home by Charlie Babb. Prime Motion is committed to protecting your privacy and respects the need to do this.

    2. 1.2 This Privacy Policy outlines the basis on which your personal data that is collected by Prime Motion from you, or in which you provide to Prime Motion, is processed.

    3. 1.3 Prime Motion, Sydney Cottage, Milsom Street, Cheltenham, Gloucestershire, GL50 4BA acts as the data controller of your personal data. For the purposes of this policy, a data controller determines the purpose and means of personal data processing.

2. INFORMATION IN WHICH PRIME MOTION COLLECTS FROM OR IS GIVEN BY YOU

    1. 2.1 Prime Motion will collect information you give to us. This information is given to Prime Motion in numerous ways including you completing forms on the website, you providing details via Zoom.com when accessing online classes, any correspondence by you to Charlie Babb of Prime Motion via phone, email, text or otherwise.

    2. 2.2 This also includes information provided to Prime Motion from you, when you register an account on the website, subscribe to any services or mailing lists, place an order for a subscription via the site or participate in any discussions on the private Prime Motion groups you have chosen to participate in, such as Prime Motion’s Inner Circle Facebook group. Information provided to Prime Motion from you may include your first name and surname, your email address provided, address, phone number and any other personal information provided voluntarily by you.

    3. 2.3 The Prime Motion site allows you to make purchases via a payment service provider, so Prime Motion may collect certain payment information from you in order for you to make purchases. This information is temporarily cached and is unreadable by Prime Motion. This information is not collected or retained in any way by Prime Motion. Prime Motion is notified by the payment service provider when your purchase has been made so we know the purchase has been successful.

    4. 2.4 When you use or access Prime Motion’s Services, we will automatically collect certain information from you. This will include information about your use and interaction with Prime Motion’s services. For example, which classes you have confirmed attendance on and which type of subscription you have booked onto.

3. USE OF THE INFORMATION COLLECTED

    1. 3.1 Prime Motion will use the information given or collected to fulfil any obligations arising from any of the contracts entered into between you and Prime Motion. For example, providing online classes to you when a subscription has been purchased by you.

    2. 3.2 Prime Motion may, from time to time, use this information to provide you with further information about our goods or services that we feel may interest you.

    3. 3.3 If Prime Motion decides to run competitions, we may use personal data collected or given by you in relation to that competition. Prime Motion may also publish names and entries of such competitions to groups in which you have agreed to participate in. If you choose to participate in such groups, Prime Motion may choose to engage with you via these means and may also re-publish your posts in these groups.

    4. 3.4 Prime Motion may also use your data to improve the services they offer to ensure the content provided by Prime Motion is presented in the most effective way for you and also to make suggestions and recommendations to you about different services which may be of interest to you. For example, telling you about a new type of class Prime Motion is delivering.

4. HOW WE WILL USE ALL INFORMATION PROVIDED

    1. Prime Motion will use all the information provided by you or collected by us in the following ways:

  • To contact you and send you relevant updates about Prime Motion’s services and offering.

  • To provide you with any support you may need in relation to Prime Motion’s services.

  • To ensure the experience you receive via the Prime Motion website is efficient and effective and to manage this account relationship properly, improving your experience where necessary.

  • As required by relevant law.

    1. 4.2.Prime Motion requires your data in order to fulfil our contracts with you, for example, provide you with online exercise classes which you have purchased.

5. DISCLOSURE OF YOUR INFORMATION

      1. 5.1.You understand that Prime Motion will share your personal information with Charlie Babb and the Prime Motion company and any member of this company.
      2. 5.2.We will only disclose your personal information to third parties if necessary, in the following ways:

        – In order to provide services to you, for example, in order to communicate with you.
        – Where the data is anonymous, and you are non-identifiable from it.
        – Where you have instructed us to do so, for example, in order to process a payment.
        – Where you have given us your consent to do so.
        – For competition purposes using social media outlets.
        – When you provide Prime Motion with a service review.
        – If Prime Motion reasonably believes they are permitted by law or have a legal obligation to do so. For example, in order to enforce Prime Motion’s terms of business or protect the rights or safety of us, you or others.

      3. 5.3. Any third parties with whom we share your personal data with may be located in a country whose data protection laws are not equivalent to the country in which you live. If Prime Motion does share your personal data with third parties, we will ensure that the protection measures Prime Motion puts in place are adequate for the data they receive.

          1. 6.1 Prime Motion stores this data within the UK primarily and we will take steps to ensure that your data is treated properly and securely. Transmission of information via the internet is never completely secure and Prime Motion cannot guarantee the security of your data, whilst we do take all the necessary precautions and try to prevent any unauthorised access. Thus, any information shared by you is at your own risk.

          2. 6.2 Prime Motion asks you not to share the password you have created for your account via the site with anyone else. We advise this password includes a mix of lower and upper-case letters and numerals.

            – Object to marketing communications from us. Contact Charlie Babb of Prime Motion to be removed from such marketing communications.

            – Delete data in certain circumstances. Prime Motion will honour this right but may need to retain certain information for reasons such as maintaining
